Inch's and Patch On Trade Competition Terms and Conditions
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.
The personal data provided by entrants will only be used by the Promoter for the purpose of conducting the promotion and at all times in accordance with the Data Protection Act 2018 and the Promoter’s Privacy Policy (available at Privacy Policy (heineken.co.uk)). From time to time, the Promoter may share entrants’ personal data with their agents/representatives to assist with administering the promotion and contacting entrants (as necessary) and/or fulfilling the prize(s).
1. Only open to GB residents aged 18 or over who are trade customers of Heineken UK Limited, who have a Heineken Direct online account and who already stock or will begin to stock Inch’s. Excludes customers in Northern Ireland, Channel Islands and Isle of Man.
2. To participate, visit Heineken Direct Inchs (heineken.co.uk) between 00:01 17th April 2023 and 23:59 on 14th May 2023. Complete the entry form on the promotion page by entering name, email address, mobile number, outlet name, outlet address, outlet type, average throughput and where you heard of the promotion.
3. By entering, you are either an Inch’s stockist, or are agreeing to stock Inch’s draught. However a Heineken UK Limited product cannot be delisted to stock Inch’s. One entry per outlet.
4. There are three prizes to be won and each prize consists of a bespoke makeover in an agreed outdoor area of the winning outlet worth up to £5000. There is also £5000 towards your energy bills which will be paid directly into each winner’s bank account. The makeover will include £2,500 of Patch plants and £2,500 INCH’S point of sale material, garden furniture, indoor and outdoor plants. Excludes INCH’S stock. The plants will be provided by Patch Gardens Limited in the form of a voucher. Voucher terms apply. POS, garden furniture will be provided by the Promoter. Prize includes a consultation from a third-party pub garden consultant, Beer Garden Co. Cirkle will organise for this consultant to visit each pub and provide advice on simple, low-cost changes the pub can make to their outdoor space. Neither the Promoter nor Patch can guarantee that any particular plants will be available. All prize elements will be agreed with the winners and will be delivered to the winners after 15th May 2023. All prize elements must be ordered together.
5. The winners will be the first three entries drawn at random from all qualifying entries by a third party (Cirkle) on 15th May 2023. Cirkle’s decision is final.
6. The Promoter reserves the right to verify all entries and the winners and to refuse to award a prize or withdraw a prize entitlement and/or refuse further participation and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter in any decisions, and these will be binding, and no correspondence will be entered into.
7. The winners will be contacted within 3 working days of the competition closing. If no response, a second attempt via email will be made within 6 working days of the competition closing. If no response a third attempt via phone call and email will be made within 9 working days of competition closing. If there is still no response within 5 working days after the third attempt, then an alternate winner will be selected and follow the same process above.
8. Winners’ details (pub name and county) will be available from group.heineken-on-trade@cirkle.com from 29 May 2023 By entering, the winner consents to such information being disclosed upon request.
9. There is no cash or other alternative to the prize in whole or in part. Prize is not transferable. The Promoter reserves the right to reclaim the prize if it is transferred.
10. The decision of the promoter in all matters is final and binding and no correspondence will be entered into.
11. The promoter is not responsible for any third-party acts or omissions. The promoter reserves the right to cancel or amend this promotion due to events or circumstances arising beyond its control.
12. All taxes (including without limitation national & local taxes) in connection with any prize & the reporting consequence thereof, are the sole responsibility of the prize winners.
13. These rules and any dispute or difference arising out of or in connection with them shall be governed by and construed in accordance with English law. The Promoter and each entrant irrevocably agrees to submit to the exclusive jurisdiction of the Courts of England and Wales over any claim or matter arising under or in connection with these rules or the legal relationships established by this agreement.
